General Policy
Destiny NewMedia asserts its right to control access to and the use of its computing facilities for the purposes of sending or receiving electronic correspondence (“e-mail”). This includes the right, without prior notice, to restrict e-mail access to any Destiny NewMedia customer or user by an outside party. Destiny NewMedia reserves the right, at any time and without prior notice, to restrict the ability of its customers and users to send e-mail using Destiny NewMedia computing facilities.
Regarding Unsolicited Commercial or Bulk E-Mail (commonly referred to as “spam”)
Destiny NewMedia opposes unsolicited commercial/bulk e-mail (hereinafter referred to as “spam” and “UCE/UBE”). Customers of Destiny NewMedia are prohibited from sending spam to the Internet. If you receive a message from a Destiny NewMedia customer that you believe is spam, please forward it (with all original Internet headers) to abuse@destinynewmedia.net and we will deal with the problem immediately. Do not use your e-mail application’s “forward” function to report abuse; you must send the message with original Internet headers intact. Contact your support personnel if you do not know how to forward e-mail in this fashion.
Spam is forbidden to Destiny NewMedia and all sites for which Destiny NewMedia is an MX host. There are no exceptions to this rule, and the preceeding statement serves as notice to all current, future, and potential senders that they are not permitted to send unsolicited commercial or bulk e-mail to Destiny NewMedia's e-mail server. We reserve the right to take any and all steps to prevent the intrusion of spam into our system, including but not limited to programmatic filters, IP blocks, and legal action.
Destiny NewMedia and its mail server reside in the Commonwealth of Virginia. Per the Virginia Computer Crimes Act of 1999, senders of UCE/UBE, senders employing fraudulent transmission means, or senders employing “spamware” (software designed to send spam, and/or circumvent protections from such messages) are committing felonies and may be subject to fines up to $25,000 US per day, jail time, and loss of goods or monies from any profit made from the UCE/UBE. If your mail was rejected by Destiny NewMedia
If you tried to send mail to Destiny NewMedia or one of its customers and it was rejected, there are four possible reasons for the rejection:
- You tried to spam someone here
- You got caught in a spam filter
- You are sending mail from an IP address identified as part of an ISP's dynamic or residential pool.
- Your e-mail address has been blocked by Destiny NewMedia management
In the event that you are an innocent party, please accept our apologies. We do not enjoy having to block large sections of the Internet in order to stop spammers from flooding our server with their unwanted excrement, and we especially do not enjoy when those blocks result in inadvertent “hits” on the innocent. Please take a moment and forward the mail you received to our extermal administrative account. We will do our best to open a portal for your e-mail to get through to our customers.
In the event you are a spammer, you should take the bounce message to heart and stop trying to send mail here. We will continue to do our best to prevent you from trespassing on our server, violating the privacy of our users, polluting the Internet, and wasting Internet resources. Please don't waste our time (and yours) with tired explanations of how your mail is “opt-in” or how your message is so urgent or critical that it just ‘has’ to be delivered. We can assure you there is no argument that will change our minds on this matter.
If your e-mail was sent from a “residential” or other dynamically-allocated IP address, you will need to use your ISP's duly-designated outgoing mail server (usually identified as the “SMTP” server) to contact Destiny NewMedia users. If your IP address is not dynamically assigned, or your ISP has mis-represented your IP address as part of its “residential” (xDSL, cable, or dialup) pool, contact us via our extermal administrative account. We will do our best to open a portal for your e-mail to get through to our customers.
In the event your e-mail was blocked by Destiny NewMedia management, you will need to contact your correspondent via other means.
Please be aware that attempting to circumvent protections instituted by Destiny NewMedia, its customers, or users may result in prosecution to the fullest extent of the law.
